CONFERENCE REGISTRATION TERMS & CONDITIONS

This document sets out the terms and conditions between The Nurse Coach Collective (“TNCC”) and you when you register for any event or conference organized by TNCC. By registering for an event or conference organized by TNCC you are agreeing to comply with these terms and conditions. You should read this document carefully.

 

ACCEPTANCE OF POLICIES AND REGISTRATION CONDITIONS

The following TNCC Registration Terms & Conditions (the “Terms & Conditions”) apply to all TNCC events. Prior to your registration, you must acknowledge and accept the Terms & Conditions contained herein. Should you not wish to accept the Terms & Conditions you should not register.

Submission of a registration is regarded as affirmation of your acceptance of the Event Terms & Conditions. 

Full Conference Registration Fee Includes:

  • Nursing professional development conference for 3 days and 4 nights at the Event Location ( see https://thenursecoaches.com/nurse-coach-conference/ for details and for Event Location)
  • Registration fee includes attendance, food, lodging for the duration, all meetings, and award of contact hours based on number of sessions you attend.
  • Event focused on Nurse Coaching and Holistic Nursing.

 

Confirmation

All registrants will receive written confirmation/receipt of registration.  If you do not receive confirmation from TNCC, please contact us at support@thenursecoaches.com.

 

ATTENDEE TERMS AND CONDITIONS

The following terms govern the purchase, attendance of, and admission to live events provided by The Nurse Coach Collective (the “Event” or “Conference”). In addition to learning about Nurse Coaching and Holistic Nursing, you may engage in physical activity such as walking to and from lodging, dining hall, event spaces, and various other outdoor spaces at the Event Location, often on uneven ground and moving around the event space. Each person purchasing and attending the Conference (“you” or “Attendee” or Participant) agrees to comply with all rules and regulations of the Conference, including, but not limited to, these Terms and Conditions below.

 

ASSUMPTION OF RISK

Attendee acknowledges that there are hazards and risks of physical injury or illness to attendees of the Conference and that not all such hazards or risks can be fully eliminated. By purchasing or attending the Conference, Attendee freely waives, releases from liability, voluntarily agrees to assume all risks, including the full risk of bodily injury or property damage, regardless of severity, or death that Attendee may sustain as a result of attending the Conference, whether or not caused by the negligence or gross negligence of Management or its agents.

 

RELEASE OF LIABILITY

In consideration of being allowed to register for, and participate in the Event, you hereby warrant and represent that you are age 18 or above and freely waive, release from liability, assume all risks, and covenant not to sue TNCC or its members, employees, board members, agents, its affiliates (or any of their respective members, customers, employees, board members, directors, agents or volunteers).or volunteers (the “Released Parties”) for any expense, loss, damage, personal injury/illness, emotional distress, including loss of life, illness, including but not limited to COVID-19, disability, property damage, or property theft or actions of any kind that you may hereafter suffer or sustain before, during, or after the event.  This Liability Waiver and Release is specifically binding upon your heirs and assigns and is knowingly given.

TNCC will hold this in-person conference when permitted as part of businesses resuming their activities following COVID-19 restrictions in the Event Location. Our conference will be structured and social distancing and other health and safety practices will be implemented as appropriate in accordance with guidelines issued by the relevant health, safety and regulatory authorities where the conference is held.  Decisions regarding the foregoing are made on the basis of our concern for the health and safety of our employees and attendees.

 

COVID-19 POLICY

We have taken enhanced health and safety measures for the protection of all our attendees, speakers, sponsors, and staff. It is imperative that all registrants for the Annual Conference follow all instructions when attending the conference.  An inherent risk of exposure to COVID-19 exists in any public place where people are present.  COVID-19 is an extremely contagious disease that can lead to severe illness and death. It is extremely dangerous to senior citizens and to any person that has underlying chronic health problems.  If you are uncertain as to your health you should not register for the conference until you have consulted a medical adviser about the risks that you may be exposed to. 

By registering for the TNCC event, you confirm that (a) you are fully aware the risks and hazards with respect toCOVID-19 inherent in your attendance and participation at the conference; (b) you freely and voluntarily agree to assume all risks that may result from contracting COVID-19, including the risk of death, bodily injury or property damage, regardless of severity, that you may sustain as a result of your attendance at the conference; and (c) you agree to release the Released Parties from all damages or claims (“Claims”) of any kind that you might suffer if you contract COVID-19, and will not hold any Released Party liable for any such Claims.

 You also assure us that at the time that you first attend the conference and for the 14 days prior:

1.You are not experiencing COVID-19 symptoms

2.You have not provided care or had close contact with any person with or reasonably suspected of having COVID-19.

3.You have not been advised by any health authority, government agency or regulation to self-isolate due to possible exposure to COVID-19.

  

RESPECT THE PRIVACY OF ALL

TNCC encourages you to take all of the learning and insight from the Conference, and apply it to your life and practice. However, refrain from revealing any personal identifying information about other Attendees without their express permission, during and after the Conference.

 

NON-DISCRIMINATION

TNCC aims to provide a welcoming and safe environment for all – a space in which we can be vulnerable and authentic with each other.

TNCC prohibits discrimination, harassment, and bullying against any person for any reason—for example, because of age, ancestry, color, disability or handicap, national origin, race, religion, gender, sexual or affectional orientation, gender identity, appearance, matriculation, political affiliation, marital status, veteran status, or any other characteristic protected by law.

 

CODE OF CONDUCT

The Nurse Coach Collective, Inc is committed to providing a friendly, safe, and welcoming environment for all, regardless of gender, sexual orientation, disability, race, ethnicity, religion, national origin, or other protected characteristics. We expect all attendees, staff, media, speakers, volunteers, and organizers to help us ensure a safe and positive conference experience for everyone.

We expect all participants to abide by this Code of Conduct in all venues, including ancillary events and all social gatherings:

  • Exercise consideration and respect in your speech and actions.
  • Refrain from demeaning, discriminatory, or harassing behavior and speech.
  • Refrain from disrupting speakers and attendees during sessions, which includes being on time to the start of each session.

Any behavior or speech of any kind that is deemed to be intimidating, harassing, discriminatory, derogatory, abusive or demeaning in any way whatsoever will not be tolerated. Examples of unacceptable behavior include, but are not limited to, comments related to gender, sexual orientation, disability, physical appearance, body size, religion, national origin, in appropriate use of nudity and/or sexual images in public spaces or in presentations, or threatening or stalking any attendee, speaker, volunteer, exhibitor, guest, TNCC staff member, service provider or other participant.  Anyone asked to stop unacceptable behavior is expected to comply immediately. If a participant engages in unacceptable behavior, TNCC staff may take any action they deem appropriate, including removal from the Conference, without refund, and/or future TNCC events. Egregious violations will result in more severe sanctions, including the possibility of reporting to local law enforcement.

 

What To Do If You Witness or Experience Conduct That Violates the Code of Conduct:

Report to any TNCC staff, and they will assist you in any way possible to feel safe for the duration of the conference by taking swift and decisive action. We value your attendance, and want to make your experience as productive and professionally stimulating as possible. You can also email support@thenursecoaches.com.

  

CANCELLATION, POSTPONEMENT, & VIRTUAL CONTINGENCY

TNCC reserves the right to make alterations to the program, date and/or venue at any time without prior notice. This includes cancellation, postponement, or transitioning to a virtual contingency plan in case of unavoidable and unforeseen circumstances. TNCC is not responsible for any loss or damage as a result of substitution, alteration, postponement or cancellation of an event due to causes beyond its control including without limitation, force majeure, pandemics, natural disasters, sabotage, accident, trade or industrial disputes, terrorism, strikes or hostilities.

Worry-Free Registration: If TNCC cancels this event for any reason, you will receive a full credit for the registration fee paid. Postponement and Virtual Contingency are not cancellations and participants will not receive a cancellation credit in those circumstances.

Postponement: If the Conference must be postponed, your registration fees will be transferred to the future event. Registrations remain valid for the Event with new dates or for future editions, if the Conference has to be postponed by causes beyond organizer control. Refund policy is not applicable in this condition.

Virtual Contingency: The virtual Conference will take place during the same dates and time of the initially planned Conference. Upon completion of the virtual Conference, TNCC will have no further liability to the attendee and no refund of any kind will be given to the attendee.

In the event of cancellation, postponement, or virtual contingency, TNCC will use reasonable and suitable alternative arrangements such as posting the news of cancellation on the appropriate event website to alert those who have booked or purchased tickets to attend the event.

 

REFUND POLICY

All cancellations require a written request and must be sent via e-mail to support@thenursecoaches.com.  Cancellation notifications via social media (e.g. posting on Facebook or Twitter, for example) or any other means are not accepted. No shows and late cancellations forfeit the full registration fee.  

  • Eligible for Full Refund: Cancellations placed before 90 days of the conference start date will receive a full refund, less $200 towards processing fee.
  • Eligible for Partial Refund: Cancellations placed within 90-30 days before the Conference are eligible for a 50% refund of total price of registration. The other 50% is non-refundable and non-transferrable. If you are paying in installments and have not yet reached the 50% threshold of the total price of registration, you will be invoiced for the remaining amount. 
  • No Refund: Cancellations placed within 30 days of the conference start date are non-refundable and non-transferable. If you are paying in installments and have not yet paid in full, you will be invoiced for the remaining amount. 

Note: Refund Policy is not applicable if the conference is postponed or transitioned to virtual contingency, for reasons including, but not limited to, natural disasters or unpredictable activities beyond organizers control including without limitation, force majeure, natural disasters, pandemics, sabotage, accident, trade or industrial disputes, terrorism, strikes or hostilities. The organizer will provide opportunity for the registered participants to transfer their registration fee and accommodation charges to any future editions or related conferences.

 

NO RECORDINGS PERMITTED

Attendee agrees not to make any recordings of or use live streaming applications or flash photography at or during any and all panels, presentations, screenings or stage performances at the Event without the express written permission of TNCC. Attendees may not copy or take screenshots of Q&A or any chat room activity that takes place in a virtual setting.

An attendee is permitted to use hand-held cameras and/or smart phones to take photographs and capture digital images for personal, non-commercial use, provided the photography is not disruptive. Photographs may not be published, sold, reproduced, transmitted, distributed or otherwise commercially exploited in any manner whatsoever. Refrain from taking photos or videos while we are in session.  

Attendee is fully responsible for any photographs or other recordings (“Recordings”) Attendee creates while at the Event, and agrees to indemnify and hold harmless the Released Parties (as defined above under “Attendees Release”) from and against any and all claims, actions, liabilities, and expenses (including attorney’s fees and costs) incurred by the Released Parties arising from or related to such Recordings, including, but not limited to, a claim that such Recordings violate or infringe the rights of another Conference attendee or other third party, including, but not limited to, such third party’s copyright, trademark, trade secret, rights of privacy or publicity, or other personal or proprietary right.

 

RIGHT TO USE NAME & LIKENESS – VISUAL / AUDIO / IMAGE RELEASE

In consideration for my participation in TNCC Conference, I hereby grant TNCC the perpetual, world-wide, royalty-free right and permission to record, photograph, use and distribute (royalty-free, both now and in the future) my image, name, and voice in all forms and media including, without limitation, photographs, electronic reproductions and transmission of images and audio files, webcasting, and any and all other users on internet for any and all TNCC lawful purposes. 

We will never release recordings of you when you are in a vulnerable state. We respect your privacy and confidentiality.

 

INDEMNIFICATION 

Attendee will defend, indemnify, hold harmless, and insure the Released Parties for and from any and all damages, loss, claims, expenses (including legal fees), or liability resulting from or arising out of, 1) any negligence or misconduct by Attendee, 2) the violation of any law or ordinance by Attendee, 3) failure of Attendee to comply with all applicable terms and conditions contained in the Terms and Conditions, 4) damages to property or personal injury caused by Attendee, or 5) from any breach or default of this Agreement that is caused by the Attendee.  All references to Attendee include such attendee’s employees, agents, representatives, or guests.

 

GOVERNING LAW 

The Terms and Conditions shall be governed by and construed in accordance with the laws of the state of Oregon, without regard to conflict-of-laws principles.

 

UNENFORCEABILITY OF PROVISIONS

If any provision of these Terms and Conditions, or any portion of it, is held to be invalid and unenforceable, then the remainder of the Terms and Conditions will nevertheless remain in full force and effect.

 

CHANGE TO TERMS AND CONDITIONS

TNCC reserves the right to change, amend, add or remove any of the provisions of this Terms and Conditions in its sole discretion and without prior notice.
